If the baby really took a breath, it should be a murder charge. Even without that particular charge, there is a myriad of other charges to use on the sick woman who did this heinous crime. Granted, I'm not an official but can think of so many ways this is a chargeable crime. She could be charged with attempted murder (leaving the woman cut open in her basement) and torture at minimum from my understanding of charges. I can also see kidnapping or something of that nature in the charges. I believe some places have a charge for theft of body parts. I would think the fetus is considered and extension of the mother for a period of time. At this point, I do begin to draw a blank on the other possibilities. At the least, this woman belongs in a mental institution with no access to anything that can cut someone open.
